🏡 What Happens If the Seller Doesn’t Have a Habitation Licence?

,

Buying a property in Spain is an exciting step, but it also comes with a few legal details that can easily catch buyers out — especially when it comes to the Habitation Licence, known locally as the Licencia de Primera Ocupación.

In this week’s Two Minute Tuesday, Keith from Target Property Spain explains exactly what this licence is, why some homes (particularly older ones) might not have one, and what you can do if the property you love doesn’t have it.

Understanding the Habitation Licence

A Habitation Licence confirms that a property complies with building regulations and is legally fit to live in. However, many older homes along the Costa del Sol — especially those built before the mid-1980s — may never have been issued one, simply because it wasn’t required at the time.

If you’re considering purchasing a home without a current Habitation Licence, don’t panic. There are safe, legal ways to proceed — the most common being to request a Certificado de No Infracción Urbanística from the local Town Hall. This certificate confirms that the property doesn’t have any outstanding urban planning violations and offers a level of reassurance to both buyers and lenders.

Why It Matters

Not having a Habitation Licence doesn’t automatically mean there’s a problem — but it’s something you should be aware of before signing any contracts. Some banks may not grant mortgages on properties without one, and connecting utilities like water or electricity can sometimes require it.

At Target Property Spain, we always recommend checking this early in the buying process. Your lawyer can confirm the property’s current status with the local Town Hall and help you obtain the right documentation, saving time and avoiding last-minute surprises.

Final Thoughts

Buying in Spain should be exciting, not stressful. With the right advice, it’s easy to stay informed and confident throughout the process.
