Holiday Rental License Clarity at Last in Mijas Costa

After months of confusion and conflicting information, there’s finally good news for property owners and buyers in Mijas Costa — and across Andalusia.

In April 2025, a major legal change turned the world of holiday rental licenses upside down. Property owners suddenly needed express permission from their community of owners to obtain a rental license.

Previously, it was enough to show that the community had not forbidden short-term rentals — a small but significant difference that caused a huge headache for anyone buying or selling a property with a license.

To make matters worse, licenses were often considered attached to the owner, not the property, meaning they couldn’t automatically transfer when a property was sold. That uncertainty left many buyers wary of investing in homes they couldn’t legally rent out.

The July Ruling: Licenses Attached to the Property

Then, in July 2025, a national ruling clarified that holiday rental licenses are attached to the property itself, not the owner — meaning they can transfer with a sale.

The challenge, however, was understanding how that ruling would be applied regionally in Andalusia. Even local experts couldn’t agree — as Keith from Target Property Spain puts it, “if you asked five experts, you’d probably get six different answers!”

Junta de Andalucía Confirms Transferability

Finally, there’s clarity. The Junta de Andalucía has confirmed that, in line with the Registro Único, existing holiday rental licenses will be honoured and transferable when a property is sold.

This is excellent news for both buyers and sellers on the Costa del Sol. Buyers can now purchase with confidence, and sellers with existing licenses can benefit from the added value those licenses bring.

If you still qualify to apply for a holiday rental license, do it now while you can. Even if you’re not planning to rent straight away, having a license adds long-term value when you sell.

You can now safely purchase a property with an existing license, knowing it will remain valid in your name.
